UPDATE: A judge has ruled that Marc Kelly was not guilty of trespass :: http://oncampus.macleans.ca/education/2010/12/15/the-strange-case-of-marc-kelly/ Student Marc Kelly was unilaterally deregistered by University Vice-President Governance Diane Davidson in late November. In her words: "it has been decided that it is in everyone's interest that you pursue your studies at another university. Your attempted onlinel registration for the Winter 2010 session is not accepted." Kelly was then delivered with a No Trespassing Notice barring him from University of Ottawa lands and buildings. In this video, Kelly is present in the Student Federation of the University of Ottawa (SFUO)'s academic appeals service, the Student Appeals Centre (SAC), making an appeal of his illegal deregistration, when University Security and then Ottawa Police arrive to arrest him for trespass, despite legal explanations of the occupancy rights (by rental agreement) of an SAC coordinator, Mireille Gervais. As seen in this video, Seamus Wolfe, SFUO President, is asked by the sergeant to obtain a copy of the SFUO's rental agreement, and leaves to obtain it. In Part 2, Seamus attempts to clarify with the sergeant why the police asked for the rental agreement and then proceeded to enter the office anyway, without reading it, to arrest a student. Mr. Wolfe was subsequently arrested.

I don't see where the dispute is. Regardless of trespass or not, the Police have the appropriate jurisdiction to arrest a student from the University. They needed no warrant given as they have conducted no search or seizure, but rather an arrest. So foolish to have tried to ward off the police.

@FTKTak Correct. More so because there is a lease agreement, and under property acts, a leaser is given ownership entitlement for the duration of the lease agreement. Ottawa U B o G may disagree with this FACT/LAW, but the law is the law. SFUO shouldn't have done anything and understood that an arrest in bad faith will NEVER hold up in courts. I figured Seamus would've known that...oohhh wait.

No wonder the cops were mad - they had to deal with the unfounded sense of entitlement exhibited by the SFUO. The SFUO was intentionally provoking the police verbally and attempting to intimidate them with cameras in their face. Have some respect for the people who risk their lives for you every day.

Courts ruled in SFUO favour. SFUO is the legal occupier of the space & has the right to determine who enters. Google it haters.

This is so outrageous, the university's trespass notice is absurd and will eventually be thrown out of court. Well done to Marc for challenging this garbage. Shame on Ottawa U for this.

The people who comment against Marc Kelly, one question do you think there is corruption within the justice system? Ofcourse! Ugh I dislike power tripping police officers! Threating to bring people to jail. All of them should have stood in the way and let the police take them to jail. They would be in the wrong. I strongly believe Marc Kelly was treated wrongly from the rock administration and justice will be repayed in due time.
